HERD SHARE AGREEMENT

Compton Family Farm Dairy VA, LLC
Raw Goat Milk Herd Share Contract – 2026

1. Purpose of Agreement

This Agreement establishes the terms under which the Shareholder purchases an undivided ownership interest in the dairy goat herd owned and managed by Compton Family Farm Dairy VA, LLC.

In exchange for this ownership interest and payment of boarding fees, the Shareholder is entitled to receive a portion of the raw goat milk produced by the herd.

This Agreement represents ownership of livestock and payment for herd care, not the retail sale of milk.

This herd share arrangement operates in accordance with Virginia Code § 3.2-5130, which allows herd share agreements for raw milk.

2. Herd Ownership

The Shareholder purchases an undivided ownership interest in the dairy goat herd owned and managed by Compton Family Farm.

The herd primarily consists of:

• Nubian dairy goats
• Nigerian Dwarf dairy goats

These breeds are selected for their rich, high-butterfat milk production.

Ownership shares correspond to the approximate weekly portion of milk produced by the herd.

Full Herd Share
Approximate weekly allocation: 1 gallon of raw goat milk

Half Herd Share
Approximate weekly allocation: ½ gallon of raw goat milk

Milk quantities are estimates and not guaranteed, as production varies naturally.

3. Share Purchase

A one-time purchase fee is required to establish ownership in the herd.

Full Share Purchase Price: $50

Half Share Purchase Price: $30

This purchase represents ownership of a portion of the herd.

Ownership may be repurchased by the farm upon termination of the agreement.

4. Boarding and Herd Management Fees

Shareholders pay a monthly boarding fee for the care and management of their animals.

Full Share Boarding Fee: $80 per month

Half Share Boarding Fee: $45 per month

Boarding fees are due at the first milk pickup of each month.

These fees support:

• animal feed and minerals
• veterinary care
• milking labor
• facility maintenance
• sanitation and milk handling
• pasture and housing management

5. Milk Pickup

Milk pickup occurs only at Compton Family Farm during designated pickup times.

Shareholders must pick up their milk during the scheduled pickup window.

Milk not collected within 48 hours of the pickup time will be forfeited for that week.

Missed milk pickups are not refundable or credited.

6. Container and Sanitation Policy

To maintain milk quality and sanitation:

• Shareholders will receive two rotating milk containers.
• A clean container must be returned to receive a filled container.
• Milk will only be dispensed into containers approved by the farm.

Fees:

Lost container: $10 replacement fee

Unclean container returned: $10 cleaning fee

The farm reserves the right to refuse filling containers that do not meet sanitation standards.

7. Milk Supply Variability

Milk production is a natural agricultural process and may vary due to factors including:

• seasonal changes
• breeding cycles
• lactation stages
• weather conditions
• herd health
• feed availability

While the Farmer makes every reasonable effort to maintain supply, specific quantities cannot be guaranteed at all times. You will be notified if quantities change.

8. Milk Handling and Testing

Milk is produced using sanitary milking practices.

Beginning in 2026, the farm may conduct periodic milk testing to monitor herd health and milk quality.

Milk is provided raw and unpasteurized.

9. Emergency Milk Disposal

The Farmer reserves the right to withhold or discard milk if it is deemed unsafe or unsuitable for distribution.

Circumstances may include:

• equipment malfunction
• milk contamination
• illness or injury within the herd
• veterinary treatments
• abnormal milk quality

Milk may be discarded at the Farmer’s discretion to protect the health of shareholders.

10. No Resale or Redistribution

Milk obtained through this herd share agreement is intended solely for the personal consumption of the shareholder and their household.

Milk may not be resold, redistributed, or used for commercial purposes.

Violation may result in immediate termination of the agreement.

11. Farm Biosecurity

To protect herd health:

• Access to livestock areas may be restricted.
• Visitors must follow farm biosecurity guidelines.
• Shareholders may be asked to avoid contact with other livestock before visiting the farm.

The Farmer reserves the right to limit or deny farm access to protect herd health.

12. Herd Management Authority

The Farmer retains full authority over herd management decisions, including:

• breeding decisions
• veterinary care
• herd health protocols
• culling or replacement of animals
• feed programs
• milking procedures

All management decisions are made in the best interest of the herd.

13. Raw Milk Risk Acknowledgement

Shareholders acknowledge that raw milk has not been pasteurized and may contain naturally occurring microorganisms.

Consumption of raw milk may pose health risks, particularly to:

• children
• pregnant women
• elderly individuals
• individuals with weakened immune systems

Shareholders accept all risks associated with raw milk consumption.

A separate Raw Milk Liability Waiver must also be signed.

14. Term and Termination

This Agreement operates on a month-to-month basis.

Either party may terminate with 30 days written notice.

Immediate termination may occur for:

• nonpayment
• violation of farm policies
• redistribution of milk
• repeated pickup violations

Upon termination, the farm may repurchase the shareholder’s herd share at the original purchase price.

15. Farm Policies

Shareholders agree to respect the farm, animals, and facilities.

Children must be supervised at all times.

The Farmer reserves the right to modify operational policies as needed for herd health or farm management.

16. Entire Agreement

This document, along with the Raw Milk Liability Waiver, constitutes the full agreement between the parties.
